Terms of ServiceDraft

Effective date: to be set at launch. This is a plain-language draft provided so the pages exist and are linkable; the final, counsel-reviewed version will be posted before paid plans go live. Questions: contact us.

1. Agreement

By creating an account or using the overwatch.earth platform (“the Service” — the console, globe builder, and embeds), you agree to these Terms. If you don't agree, don't use the Service.

2. The Service

The Service lets you compose interactive globes from third-party live-data feeds and publish them as embeds. The underlying data is aggregated from public and third-party sources (see Data sources); we don't own it and can't guarantee its accuracy, completeness, or availability.

3. Your account

Provide accurate information, keep your password secure, and you're responsible for activity under your account. One person or organisation per account unless agreed otherwise. You must be able to form a binding contract to use paid plans.

4. Acceptable use

Don't use the Service to break the law, infringe others' rights, send spam, probe or disrupt our systems, or embed content in a way that misrepresents its source or overloads upstream data providers. You're responsible for the sites you embed globes on and for respecting each data source's own terms.

5. Advertising

overwatch.earth is free to view, and we run advertising to pay for it. Ads are served by Google AdSense and configured as non-personalised: they are chosen from the page's subject and coarse location rather than a profile of your browsing history. We do not set advertising cookies of our own, we do not share or sell your data to advertisers, and we do not build advertising profiles. Our ad provider may still set cookies or similar storage of its own for frequency capping, measurement and fraud prevention; that is Google's processing under Google's policies, not ours. Ads are visually separated from the globe and its data - we never present sponsored content as a live data layer.

6. Affiliate links

Some outbound links are affiliate links: if you follow one and buy something, we may earn a commission at no extra cost to you. Affiliate links are marked as affiliate links wherever they appear, so you always know before you click. Affiliate relationships never influence which data sources we include, how layers are chosen or ranked, or anything shown on the globe.

7. Plans, billing & trials

Free and paid plans have the limits shown on the pricing page when the platform launches. Paid subscriptions (when billing is enabled) are billed in advance on a recurring basis via our payment processor; you can cancel from the billing portal and cancellation takes effect at the end of the current period. Fees are non-refundable except where required by law.

8. Your content

You keep ownership of your globe configurations and account data. You grant us the limited licence needed to host, process, and serve your globes and embeds. You can delete your globes at any time; contact us to delete your account.

9. Availability & changes

We aim for high availability but provide the Service “as is” and “as available”, without warranties. We may change, suspend, or discontinue features, and will give reasonable notice of material changes where practical.

10. Limitation of liability

To the extent permitted by law, we're not liable for indirect or consequential damages, or for loss arising from third-party data inaccuracy or unavailability. Our total liability is limited to the amount you paid us in the 12 months before the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms. On termination, your right to use the Service ends; we may delete associated data after a reasonable period.

12. Changes to these Terms

We may update these Terms; we'll post the new version here and, for material changes, notify account holders. Continued use after changes means you accept them.
